This is a summary of Kenny Blyth's key terms of business for voice-over services.

For this agreement, the Artist refers to Mr Kenny Blyth and the Engager (or "you") refers to the person or organisation hiring his services as a voice-over artist.

By hiring Kenny Blyth, you agree to these terms and conditions (also referred to as the "Agreement" below).

Fees

  • The Engager will pay the Artist the fee agreed between them for the services and usage of the recording (or recordings).
  • The Artist's quotes and invoices are not inclusive of UK VAT taxes.
  • The payment of the Artist's fees is due within 30 days of the date shown on the invoice sent to the Engager, unless otherwise agreed.

Usage of recordings

  • The recordings can only be used by the Engager for the strict usage and purposes agreed by Artist and recorded in writing.

Licence

  • The Artist owns the copyright and other applicable rights in the recordings fixing his contribution, in his performance, likeness (including voice) and personal data, supplied to the Engager when delivering his services.
  • The Artist grants the Engager a licence for the copyright and other applicable rights contained in these recordings.
  • This licence is:
    • limited to the type, duration and scale of use agreed by the parties.
    • personal, this means it allow for the use of the recordings by the Engager (and the end client where applicable) only.
    • non-exclusive, this means that the Artist can licence the recordings or its content with others.
    • non-transferable, this means that the Engager (or the end client) cannot assign the benefits of the licence (in part or in full) to another party without the Artist’s express, written and informed consent.
  • This licence excludes the use of the recordings or its content for the purpose of reproduction or synthetisation of Kenny Blyth’s performance, likeness or voice. This licence also excludes the use of the recordings or its content for the purpose of training machine learning models or equivalent technology.

Moral rights

  • The Artist asserts his moral rights to be attributed as the performer (as "Kenny Blyth") and to object to the derogatory treatment of his performances that would be prejudicial to his reputation or that of his work.
  • The Artist reserves the right to waive his moral rights for an appropriate fee. The Artist’s waiver of his moral rights is only valid if it is given by him, express, recorded in writing and remunerated.

Artificial Intelligence and machine learning

  • This Agreement excludes all and any use of the content supplied by the Artist to the Engager for the purpose of data mining, reproduction, synthetisation or cloning of the recordings, the Artist's performance, likeness, or other contributions made in the context of services he supplied to the Engager. This Agreement also excludes all and any use of the content supplied by the Artist for the purpose of training machine learning technologies or artificial intelligence ("AI") systems on the Artist's recordings, performance, likeness, or other contributions made by him as part of his services. This applies to all technologies present and future, known or not known at the time the Agreement is made.
